Between his service as a trial judge and arbitrator, Judge Downey has presided over thousands of civil trials throughout Texas. In additional to applying the federal and Texas rules of evidence in such matters, he also teaches evidence as an adjunct professor at South Texas College of Law. While the rules of evidence in arbitration are applied in a more liberal fashion than they would be in a court of law, Judge Downey believes such rules are the result of centuries of experience in the administration of justice and still have a place in an arbitration proceeding. Additionally, he considers the rule of stare decisis to have application to arbitration cases and considers federal and state case law to be more than merely advisory.
